Terms and Conditions

Effective Date: November 5, 2026

Welcome to soundstage9.com, operated by Sound Stage 9, LLC (“Sound Stage 9,” “we,” “us,” or “our”).

These Terms and Conditions govern your use of our website and SMS messaging program. Enrollment in lessons, bands, camps, artist development, recording services, or other programs may require a separate agreement.

1. Acceptance and Scope

Please review these Terms before using our website or subscribing to our messaging program. If you do not agree, please discontinue the applicable use.

Where affirmative acceptance is required, we will request it through an appropriate enrollment, purchase, or subscription process.

If a separate signed agreement addresses a specific service, that agreement controls in the event of a conflict concerning that service. These Terms do not replace enrollment agreements, payment authorizations, media releases, or other signed agreements.

2. Our Services

Sound Stage 9 offers music education and related services, which may include private and group lessons, bands, camps, workshops, performances, artist development, and recording or production services.

Availability, instructors, locations, schedules, eligibility, and program offerings may vary. Website descriptions are informational and do not guarantee enrollment, a particular instructor, or participation in a specific opportunity.

3. Parents, Guardians, and Minors

A parent or legal guardian must complete enrollment and provide required authorizations for students under 18.

Parents and guardians are responsible for providing accurate contact and emergency information and complying with applicable attendance, supervision, pickup, and program requirements.

Children under 13 should not independently submit personal information through our website. A parent or guardian should complete forms on their behalf.

4. Enrollment, Tuition, and Payments

Submitting an inquiry, trial request, or enrollment form does not guarantee placement. Enrollment is subject to confirmation, availability, and completion of required agreements and payment arrangements.

Tuition, fees, payment schedules, recurring charges, and any authorized late fees are governed by the terms disclosed before enrollment or purchase.

Recurring payments require an applicable payment authorization. These website Terms alone do not authorize automatic charges.

Changes to ongoing service prices will be communicated as required by the applicable agreement and law.

5. Attendance, Cancellations, and Refunds

Lesson cancellations, missed lessons, makeup lessons, withdrawals, enrollment pauses, and refunds are governed by the applicable enrollment or service agreement and policies disclosed before purchase.

Please review those policies before enrolling. If you have questions, contact us before completing your purchase.

Nothing in these Terms limits refund or cancellation rights required by applicable law.

6. Scheduling and Program Changes

We may need to adjust instructors, schedules, locations, or program arrangements because of illness, availability, weather, facility issues, or other operational circumstances.

We will make reasonable efforts to communicate changes. Any applicable makeup, credit, refund, or rescheduling rights remain governed by your service agreement and applicable law.

7. Student and Visitor Conduct

Students, families, and visitors must treat instructors, staff, other students, facilities, and equipment respectfully.

Harassment, threats, discrimination, unsafe conduct, and intentional property damage are prohibited.

We may restrict participation or access when reasonably necessary to address safety concerns, serious misconduct, or material violations of an applicable agreement. Any related financial consequences will be handled under that agreement and applicable law.

8. Educational Outcomes and Opportunities

Student progress depends on factors including attendance, practice, preparation, participation, and individual circumstances.

We do not guarantee a particular skill level, audition result, award, recording contract, commercial success, or other specific outcome.

Performances, recording sessions, music videos, and promotional opportunities may have separate eligibility requirements, permissions, costs, and agreements. They are not automatically included in every enrollment.

9. Website Use and Accounts

You agree to provide accurate information and use our website and connected systems lawfully.

You may not:

  • Attempt unauthorized access to accounts or systems.

  • Introduce malicious software or interfere with website operation.

  • Impersonate another person or submit information without authorization.

  • Use website forms to send unlawful, abusive, or unsolicited content.

  • Copy or exploit protected website content without permission.

If you receive account credentials, keep them confidential and notify us promptly of suspected unauthorized access.

10. Intellectual Property and Student Work

Website text, branding, logos, graphics, and other original materials owned by Sound Stage 9 are protected by applicable intellectual property laws.

Third-party content remains the property of its respective owners. You may not reproduce or commercially use protected materials without appropriate permission.

Students retain their rights in original songs, recordings, performances, and other creative work except as otherwise provided in a separate written agreement. These Terms do not transfer student copyrights, publishing rights, or master recording ownership to Sound Stage 9.

11. Photos, Video, and Audio

Photography, filming, recording, and promotional use of identifiable student media are governed by applicable permissions and separate media releases.

These Terms do not independently grant us permission to use a student’s likeness, voice, performance, or creative work for advertising.

Please contact us with questions about media permissions or preferences.

12. SMS Messaging Terms

Program Description

The Sound Stage 9 SMS program may include lesson reminders, scheduling updates, school announcements, event information, enrollment opportunities, and promotional offers, according to the permissions you provide.

Consent Disclosure

By providing your mobile phone number, you agree to receive text messages from Sound Stage 9 at the number provided, sent using an automated system. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. For additional assistance, contact [Customer Care Email Address or Phone]. Carriers are not liable for any delayed or undelivered messages. See our Privacy Policy (https://www.soundstage9.com/privacy-policy) for how we handle your personal information.

This disclosure applies when you provide your number through an SMS opt-in process and affirmatively consent to the identified messages. Providing a phone number solely for enrollment, billing, scheduling, or an inquiry does not automatically enroll you in promotional texts.

Our SMS program is intended for adults, including parents and legal guardians communicating on behalf of students.

By subscribing, you confirm that you are the subscriber or authorized user of the phone number provided and are authorized to consent to messages at that number. Please notify us if you change or relinquish the number.

Message Delivery and Charges

Message frequency varies based on your subscriptions and interactions with us. Your carrier’s message and data rates may apply.

Delivery depends on your carrier, device, network availability, and other technical conditions. Text messages should not be used for emergencies or urgent safety matters.

Privacy

Personal information associated with the SMS program is handled as described in our Privacy Policy.

We do not sell or share mobile subscriber information with third parties or affiliates for their own marketing or promotional purposes.

All the above categories exclude text messaging originator opt-in data and consent; this information won’t be shared with any third parties.

13. Third-Party Services and Links

Our website may link to or use third-party services for scheduling, student management, payments, communications, social media, or other functions.

Those services may have their own terms and privacy policies. We do not control independent third-party websites or guarantee their availability or content.

Using a third-party provider does not eliminate any responsibilities we have under applicable law.

14. Privacy

Our Privacy Policy explains our information practices and available privacy choices. It is available at:

https://www.soundstage9.com/privacy-policy

These Terms do not replace any consent separately required for marketing, student media, sensitive information, or other activities.

15. Website Availability and Information

We make reasonable efforts to keep website information accurate and current, but errors or interruptions may occur.

To the extent permitted by law, the website is provided on an “as available” basis without guarantees of uninterrupted access or error-free content.

This provision does not alter commitments made in a separate service agreement or warranties and rights that cannot lawfully be excluded.

16. Limitations of Liability

To the extent permitted by applicable law, Sound Stage 9 is not responsible for indirect or consequential losses arising solely from website interruptions, unauthorized website misuse by others, or reliance on general website information.

Nothing in these Terms excludes liability for fraud, gross negligence, willful misconduct, or any liability that cannot legally be limited.

These Terms are not a release of claims for personal injury and do not waive nonwaivable consumer rights.

17. Events Beyond Our Reasonable Control

Events such as severe weather, utility outages, government restrictions, or facility emergencies may affect our operations.

We will make reasonable efforts to notify affected families and explain available arrangements. Any payment, rescheduling, credit, or refund obligations remain subject to the applicable agreement and law.

18. Governing Law and Disputes

These Terms are governed by Texas law, except where applicable federal law or mandatory consumer protections provide otherwise.

Please contact us first so we can attempt to resolve concerns.

Unless a separate enforceable agreement provides otherwise, disputes may be brought in a court with appropriate jurisdiction in El Paso County, Texas, subject to applicable venue rules and mandatory consumer rights.

These Terms do not require arbitration or waive the right to bring a claim where permitted by law.

19. Changes to These Terms

We may update these Terms periodically. The updated version will be posted with a revised effective date.

Changes apply prospectively and do not retroactively alter existing signed agreements. We will provide additional notice or request renewed acceptance when required by law.

Changes to these Terms do not independently expand your SMS consent.

20. Severability

If a provision is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.
